Florida Lawmakers Consider Nursing Home Litigation Bill

In the final weeks of the state legislative session Florida Lawmakers are considering a measure to limit who can be sued when a nursing home is accused of abuse or neglect. Supporters say the bill, which ends years of feuding between the Florida Health Care Association and the Florida Justice Association, protects passive investors who are not involved in the care of residents from facing litigation and that it could help nursing homes stay financially solvent.

Opponents argue those same investors could be involved in pressure to cut nursing home costs and staffing levels and that the bill puts the interests of investors over the needs of elder residents. As the Senate has already passed the bill and the House takes it up this week, we’ll hear arguments from both sides.
